Immediate Action Steps Recommended by the Splash Pad/Farmers Market Advisory Committee (SPFMAC)

Farmers Market Management

Preface: Farmers Market Management agrees to work with the Splash Pad Park /Farmers Market Advisory Committee to mitigate impacts on the park.

1. Amend Ground Rules for Vendors to include the following:

  • All food vendors must use non-permeable tarps.
  • All vendors located on lawn or sod should use a protective mat under their stall (David Skinner, of the Public Works Agency, shall specify an acceptable mat. Alternates of equal effectiveness may be used if approved by David Skinner.) Mats are not necessary for non-food vendors located on gravel, DG or asphalt.
  • No grease, charcoal or hot water shall be disposed of on Splash Pad Park grounds, including in the trash receptacles. Vendors must take these materials out of the park for appropriate disposal. Clean water of mild temperature only may be disposed on the premises in a responsible manner.
  • All vendors must cease all business operations at 2:00 p.m. and vacate the park not later than 4:00 p.m. No exceptions.

  • 2. Farmers Market Management will undertake immediate and strict enforcement of all Ground Rules for Vendors without exception and undertake appropriate disciplinary measures or expulsion of vendor(s) from the market for failure to comply with Ground Rules.

    3. Farmers Market Management must either remain in the park until all vendors have vacated or return for final inspection and clean-up not later than 4:00 p.m., ensuring that all vendors have left the park, that trash receptacles are empty and that park is in a clean condition post-market operation.

    4. Farmers Market Management will purchase additional mats (as specified by Public Works Agency) and make sure at the opening of the market every Saturday that every vendor is using a mat under his/her stall.

    5. Provide steam cleaning in Splash Pad Park on an as needed basis, but a minimum of twice yearly, or more often as recommended by SPFMAC. Report to SPFMAC vendor used for steam cleaning and provide written schedule for cleaning to SPFMAC.

    6. Provide a list of all vendors, indicating product sold, and a map of typical vendor location on a quarterly basis to the SPFMAC.

    7. Farmers Market Management shall not expand the size of this market and shall work with the SPFMAC to determine the appropriate footprint for the market and the mix of vendors in the market, as it impacts the sustainability of park land, and commerce in the larger commercial district.

    8. Farmers Market Management shall work with SPFMAC and Public Works Agency to relocate or reorganize vendors to limit heavy impact on the park where appropriate.

    9. The popcorn vendor must be required to utilize the appropriate non-permeable ground cover. FMM will be responsible for monitoring and cleaning of ground surface if any staining is identified.

    10. Unless alternative parking space is identified and utilized in the next 30-60 days, Farmers Market Management must immediately resolve the vendor parking issues by paying the set annual fee to the City of Oakland for vendors parking at 18 curb-side meters and prohibiting all vendors, except those requiring ongoing access to refrigerated trucks, from using public parking spaces under the freeway except for period of time when they are actively loading and unloading.

    11. Purchase and erect appropriate barriers to direct foot traffic away from damaged areas that are being rehabilitated or areas that are particularly vulnerable to use by the Farmers Market.

    12. Farmers Market Management shall provide annual reports including participation of farmers, a financial report including revenues and expenses, and other information indicated by the SPFMAC.

    City of Oakland Public Works

    1. Must send a representative to SPFMAC meeting at least once per year or more frequently if SPFMAC agenda requires attendance.

    2. Provide specific recommendation as to recommended type of mat that vendors (as defined in FMM section 1 above) should use under their stalls.

    3. Should devise a specific maintenance program and budget for Splash Pad Park, including the amount of financial and human resources that the City is willing to contribute to the park annually.

    4. The shall provide debris collection at 4:00 p.m. at the end of market days

    District 2 City Council Office

    1. Schedule meeting with Farmers Market Management to Discuss SPFMAC Recommendations.

    2. Should include article in District 2 newsletter to encourage walking and biking to the market

    3. Should support and encourage cross promotional efforts to bridge the interests of local merchants and the Farmers Market.

    4. Should explore potential to redevelop Grand Avenue parking facility to accommodate additional vehicles and other means to mitigate parking impact in the commercial district.
